Heat Straps™ is an ancillary device that should not be worn alone, but in conjunction with other required safety equipment. Many individual components of the Heat Straps™ have been 3rd party tested for heat and flame resistance, but the Heat Straps™ as a whole has not been tested by a 3rd party. Therefore, the Heat Straps™ have not been proven to be intrinsically safe, as well as being heat, flame, impact, and water resistant according to a specific 3rd party requirement so as to insure its appropriateness. All users assume full responsibility for the use and application of the Heat Straps™.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Heat Straps LLC DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, ORAL OR IN WRITING, INCLUDING, WITHOUT LIMITATION, WITH RESPECT TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
UNDER NO CIRCUMSTANCES SHALL Heat Straps LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFIT, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT OR TORT OR BASED ON A WARRANTY, EVEN IF THE PARTY CLAIMING SUCH DAMAGES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. HEAT STRAPS LLC’S AGGREGATE LIABILITY SHALL NOT EXCEED THE DOLLAR AMOUNT PAID FOR THE ITEM IN QUESTION.
Heat Straps LLC offers a Limited Warranty for its products, covering against defects in materials and workmanship conforming to a period of 90 days from the date of retail sale. During the warranty period, the product could be replaced, at Heat Straps LLC’s discretion. Heat Straps LLC will also permit a return in rare instances that a product is damaged in transport. This Limited Warranty is void if any defects are caused by abuse, misuse, negligence or unauthorized modifications or repairs made to Heat Straps LLC’s product. All liability for incidental or consequential damages is specifically excluded. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to the customer.
